1. Definitions

The company refers to “Berrymans Bakery”. The buyer refers to the purchaser of our goods and services.

2. Summary

The company only accepts orders subject to the conditions of sale, to the exclusion of any condition of the buyer.

3. Liability

The Company’s liability to the buyer shall at no time exceed the price of the goods supplied. The Company shall be under no liability for any direct loss and/or expense or any indirect loss and/or expense suffered by the buyer or liability to third parties incurred by the buyer. This contract is subject to the law of England and Wales.

4. Payment

Goods shall not pass to the buyer until they are paid for in full prior to despatch.

5. Prices

Prices of goods and services supplied may be subject to market fluctuation and revision.

6. VAT

All of the company’s prices are inclusive of UK sales tax (VAT), charged at the current rate, except for items that are zero rated or exempt from VAT.

7. Fitness for Purpose

The company is in no way liable for the purpose and fitness of goods and services supplied to the buyer. The company has no control over the fitness, suitability and method of their use. The company excludes any condition or warranty implied by statute or otherwise as to the fitness of its goods or any other particular whatsoever.

8. Delivery

The Seller shall use its reasonable endeavours to meet any date agreed for delivery. In any event time of delivery shall not be of the essence and the Seller shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date. Delivery of the Goods shall be made to the Buyer’s address specified in the order.

The Buyer is responsible for making suitable arrangements to receive the delivery and giving appropriate instructions. In the event that the delivery is stolen from the Buyer’s doorstep or damaged while there, the Seller does not accept liability, and will offer compensation at their discretion. The seller reserves the right to refuse to accept orders from any customer; considerations of delivery problems may give rise to such a refusal. We endeavor to keep your delivery day the same, but we reserve the right to change it and will tell you if we do so. If we are unable to deliver to you, or have to deliver late, for reasons beyond our control, for example adverse weather conditions, strike actions, vehicle breakdown, traffic congestion or supplier failure, we cannot accept liability for any inconvenience or loss that this causes.

9. Defective Goods

We guarantee the quality of all of our products. You must inspect the products and notify us promptly of any damage with your order.

10. Cancellation Right

In the case of perishable items you do not have the right to cancel the contract.
